Weaver Schlenger Thoughts on DACA and How Employers Can Help

January 25, 2023

Dreamers and DACA recipients play a critical role in the United States economy and in the broader U.S. society. The Dream Act would provide a pathway to citizenship for those individuals who have been living in the United States without proper immigration status since childhood. It’s disappointing that Congress has not passed the Dream Act, which was first introduced more than twenty years ago.

In June 2020, the Supreme Court narrowly ruled that President Trump’s attempt to terminate DACA was procedurally defective. However, DACA is under threat again, and the question of its legality will likely reach the Supreme Court again within the next two years. Most legal experts predict that the Supreme Court will likely strike down the employment authorization part of DACA.

As members of the immigration community, Weaver Schlenger stands with Dreamers and will continue to advocate for the future of DACA. We have allied ourselves with Immigration Law Professor Bill Hing, of the University of San Francisco, who has vigorously pursued justice throughout his distinguished career via litigation, community work, and scholarship. He currently serves as the Director of USF’s Immigration and Deportation Defense Clinic. Together, we seek the support of the business immigration community in signing on to a petition to express steadfast support for DACA.

Please consider taking a stand in favor of passing the Dream Act. One way is to go to the FWD.US website where you can sign a pledge to support Dreamers: FWD.US was founded by Mark Zuckerberg in 2013, and the website has a great deal of relevant information.

If you would like to learn more about strategies that may be available to you and your Dreamer employees if DACA is terminated, or other ways your company can help to make a path to permanent residence possible for these young Americans, we encourage you to contact Professor Bill Hing at:
